Terms of Service

PhotoOnSpot Media LLC · Effective October 29, 2026

These terms are an agreement between you and PhotoOnSpot Media LLC ("PhotoOnSpot", "we") for using PhotoOnSpot Autopilot, the app that turns the videos and photos you capture into a finished video. By creating a workspace, signing in or paying, you accept these terms and our Privacy Policy.

The service

• You upload your shots following a template; Autopilot (with AI) edits them, adds music and your brand, and delivers a video.
• AI is used to plan the edit and, if you ask for it, to add camera motion to some shots. AI can change small details. Review your video before you approve, download or publish it.
• We may change, improve or discontinue features. If we discontinue the service, we will give you reasonable time to download your videos.

Your account

• You must be at least 18 and able to enter into a contract, and you use the service for yourself or for a business you are allowed to represent.
• Keep your email and devices secure; anyone with your sign-in code or workspace key can use your workspace.

Your content

• You keep all rights to what you upload and to your finished videos. You give us a limited license to store, process and show your content only to provide the service to you (including through the providers listed in the Privacy Policy).
• You confirm you have the right to upload your content, including permission from people who appear in it and from property owners where needed, and the right to use any logo, name or license number you add.
• Do not upload anything illegal, infringing, sexually explicit, hateful, or that violates someone's privacy. We may remove such content and close the account.
• Real estate listings: you are responsible for following the rules of your MLS, the Florida Real Estate Commission and fair housing laws. Do not use a video to misrepresent a property; disclose any staging or editing your MLS requires.
• We do not use your content in our own marketing unless you turn on the optional checkbox on a finished video. By turning it on, you confirm that every identifiable person in the video (and the owner of any property or business shown) agreed to this use. That permission covers only that finished video, on our website and social media, without payment to you, and you can turn it off at any time; we then stop using it in new content and remove it from our website and the profiles we control within 30 days. Deleting the project also turns it off.
• Original uploads are deleted starting 90 days after the project is created (with an email notice at least 7 days before if you signed in with email). After that, the finished video stays, but it can no longer be edited or enhanced. Download what you want to keep.

Music

Music in your video is licensed or created for use in that video. You may use the finished video, with its music, to promote yourself or your business on websites and social media. You may not extract the music to use it separately.

Prices, payments and plans

• Prices are shown in the app before you pay, in US dollars. Payments are processed by Stripe.
• A paid video includes one round of changes (a change request or an edit), available while your originals are kept, and, for templates that support it, AI enhancement when available. If enhancement can't be applied, your video is delivered with your original shots and you can request it again.
• Plans renew automatically each month or year, at the price shown when you subscribed, until you cancel. You agree to this with a checkbox before you pay, and we keep a record of that consent. You can cancel at any time online, in the app (My videos > Manage subscription); the plan stays active until the end of the period you already paid for. For yearly plans we email you 30 to 45 days before each renewal with the price and date. If the price changes, we tell you before it applies. Plan videos renew monthly from your subscription date, also on yearly plans, and unused videos do not carry over. If a renewal payment fails, plan videos pause until it's paid.
• A free trial includes up to 3 videos, without AI enhancement or your brand, and ends with "Made with PhotoOnSpot". Beta accounts have a daily video limit.

Refunds

• Once your video has been delivered, what you paid is not refunded; use your round of changes if something needs fixing.
• If your video cannot be built, you can try again up to 3 times without paying again. If it still can't be built, you choose: what you paid stays in your account as a credit for your next video, or we refund it to your card (in the app or by writing to us, while the credit is unused). Free credits are used before paid ones. If you delete your account, unused credits from videos we could not build are refunded. A video from your plan or a free credit comes back to your account.
• If you are charged twice, or pay for a project you had already deleted, we refund it automatically.
• If something else went wrong, write to contact@photoonspot.com within 30 days and we will review it and, where appropriate, redo the video or add a credit to your account.

Acceptable use

Do not try to break, overload, reverse engineer or get around the limits of the service, access other people's workspaces, or resell the service without our written permission.

Disclaimers and limits

• The service is provided "as is". We do our best, but we do not promise it will be uninterrupted or error-free, or that a video will achieve a particular business result.
• To the extent the law allows, PhotoOnSpot is not liable for indirect, incidental or consequential damages, lost profits or lost data, and our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or US$100.
• You agree to cover PhotoOnSpot for claims caused by content you upload or by your breach of these terms.

Copyright complaints

If you believe content on PhotoOnSpot infringes your copyright, send a notice to our designated agent at contact@photoonspot.com with: your contact details, the work you own, where the content is, a statement that you believe in good faith the use is not authorized, a statement under penalty of perjury that your notice is accurate and that you are the owner or authorized to act for the owner, and your signature. We remove infringing content and close the accounts of repeat infringers.

Ending

You can stop using the service and delete your account at any time from the app ("Delete my account"); this cancels your plan right away, and unused plan videos and free credits are lost (paid credits are refunded, as described above). We may suspend or close accounts that break these terms. Sections about content rights, limits of liability and governing law continue after the account closes.

Governing law

These terms are governed by the laws of the State of Florida, United States. Disputes will be handled in the state or federal courts located in Hillsborough County, Florida, unless the law where you live gives you the right to another forum.

General

• These terms and the Privacy Policy are the whole agreement between you and PhotoOnSpot about the service. If a part of these terms can't be enforced, the rest still applies. Not enforcing a part is not a waiver.
• You may not transfer your account or these terms without our consent; we may transfer them to a company that takes over the service.
• You agree to receive notices, sign-in codes and receipts electronically, by email or in the app.
• These terms are written in English and translated to Spanish. If the versions differ, the English version controls.

Changes and contact

If we change these terms, we will update the date above and, for important changes, tell you in the app or by email before they apply. Questions: contact@photoonspot.com.
